Assignment of claims in bankruptcy – What is at issue?
If bankruptcy proceedings are opened against a debtor, he loses control over all his seizable assets. These then form the bankruptcy estate, which is managed and represented by the receiver. The receiver must conduct all business for the purposes of preserving and realising the bankruptcy estate and will also represent it in court. The receiver is also responsible for collecting all undisputed due credits.
